Terms of Service

These Terms of Service (“Terms”) form a binding agreement between QFIELD PTY LTD (ABN 73 683 282 911) (“QField”, “we”, “us”, “our”) and you, the person or entity using the Service (“you”, “your”).
By creating an account, accessing, or using the QField mobile or web application, or any related services (the “Service”), you agree to these Terms. If you are accepting these Terms on behalf of a company, you confirm that you have authority to bind that company.
If you do not agree to these Terms, do not use the Service.
1. The Service
QField is a software-as-a-service platform for the construction industry. It enables builder companies to manage construction projects and to coordinate with subcontractors, clients, and consultants on inspections, fire penetration installations, defects, and project documents.
The QField mobile application is designed for use on construction sites where mobile coverage is unreliable. The app stores work you create offline on your device and uses your device’s standard background-task system (iOS Background App Refresh and Android background tasks) to finish uploading that work when a network becomes available, even when you have closed the app. Background sync uses a small amount of battery and, when WiFi is not available, may use cellular data. You can disable background sync in your device settings; see the Privacy Policy, Section 1.7 (Background processing and offline sync), for instructions and for the full description of what does and does not run in the background.
We may add, modify, or remove features of the Service from time to time. We will give you reasonable notice of material changes that adversely affect your use of the Service.
2. Accounts and access
2.1 Eligibility
You must be at least 16 years old and legally capable of entering into a contract to use the Service. The Service is intended for use by businesses operating in the construction industry.
2.2 Company accounts and roles
QField is structured around company accounts. The first user to create a company account becomes that company’s administrator and is responsible for inviting additional users, assigning roles, and managing access. Where you use the Service as an employee or contractor of a company, that company is the Customer under these Terms; your individual use is subject to that company’s instructions.
2.3 Account security
You are responsible for:
- Keeping your password and any device used to access the Service secure
- All activity that occurs under your account
- Notifying us promptly at support@qfield.com.au if you suspect unauthorised access to your account
If you no longer want to use the Service, you can delete your account at any time (see Section 10.1A).
3. Subscriptions, billing, and trials
3.1 Plans and fees
Use of the Service by a builder company is subject to a subscription plan. Pricing, included usage limits (projects, users), and overage fees are described on our pricing page and within the Service. Fees are charged in Australian Dollars (AUD) unless stated otherwise.
3.2 Trial periods
Where a trial period is offered, your subscription will automatically convert to a paid subscription at the end of the trial unless you cancel before the trial ends.
3.3 Payment processing
Billing is processed by Stripe. By providing payment details to Stripe, you agree to Stripe’s terms. We do not see or store your full payment card details.
3.4 Renewal and cancellation
Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from within the Service or by contacting support@qfield.com.au.
- Monthly plans: cancellation takes effect at the end of the current monthly billing period. We do not provide pro-rata refunds for partial months.
- Annual plans: cancellation takes effect at the end of the current annual billing period. We do not provide pro-rata refunds for the unused portion of the annual term, except where required by Australian Consumer Law or where we expressly agree in writing.
Cancelling a subscription is not the same as deleting your user account. Subscription cancellation is described above. Account deletion is described in Section 10.1A.
Nothing in this Section limits your rights under Australian Consumer Law (see Section 11).
3.5 Overage and metered usage
Some plans include a fixed allowance of projects and users with metered overage charges for usage above that allowance. Overage is reported to Stripe and billed at the rates listed on our pricing page.
3.6 Late payment
If a payment fails, your subscription may enter a grace period during which read-only access continues. Continued failure may result in suspension or termination of the subscription. We will notify you before taking any such action.
4. Your content
4.1 Ownership
You retain ownership of all content you submit to the Service, including projects, inspection records, photos, documents, defects, and messages (“Your Content”).
4.2 Licence to QField
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, copy, and process Your Content solely as needed to provide the Service to you, to make backups, to provide support, and to comply with legal obligations.
We do not use Your Content to train, fine-tune, or evaluate machine learning, generative AI, or large language models, and we do not licence Your Content to any third party for those purposes. Where Your Content is processed by a sub-processor (see our Privacy Policy and Sub-processors pages), it is processed only to deliver the relevant feature of the Service.
4.3 Responsibility for Your Content
You are solely responsible for Your Content. You represent and warrant that:
- You have all rights necessary to upload Your Content and to grant the licence above
- Your Content does not infringe any third party’s intellectual property, privacy, or other rights
- Your Content does not contain unlawful, defamatory, harassing, obscene, or otherwise objectionable material
- You have obtained any consents required by privacy law from any individuals whose personal information appears in Your Content
4.4 Removal
We may remove Your Content from the Service if we reasonably believe it breaches these Terms or applicable law. Where practical we will give you notice and an opportunity to respond.
5. Acceptable use
You must not:
- Reverse engineer, decompile, or attempt to derive source code from the Service
- Probe, scan, or test the vulnerability of the Service except as expressly permitted by us in writing
- Interfere with or disrupt the Service or the servers or networks that provide the Service
- Use the Service to send spam, malware, or any unlawful content
- Use the Service to impersonate any person or entity
- Use automated means (bots, scrapers) to access the Service except through APIs we provide
- Use the Service in a way that violates Australian law or the law of any other jurisdiction that applies to you
6. Third-party integrations
The Service may offer optional integrations with third-party platforms (for example, Aconex). When you connect a third-party integration:
- You authorise QField to exchange data with that third party on your behalf
- Your use of the third party is governed by that third party’s terms and privacy policy
- We are not responsible for the acts or omissions of third parties
7. Intellectual property
The Service, including all software, designs, trademarks, logos, and documentation, is owned by QField or our licensors and is protected by intellectual property laws. These Terms do not grant you any right in the Service other than the right to use it during the term of your subscription.
8. Privacy
Our handling of personal information is described in our Privacy Policy. By using the Service you confirm you have read and understood the Privacy Policy.
9. Availability and support
We will use reasonable efforts to make the Service available 24 hours a day, 7 days a week, but we do not guarantee uninterrupted availability. Planned maintenance, third-party outages, and events outside our reasonable control may affect availability.

10. Suspension and termination
10.1 Termination by you
You may cancel your subscription at any time. Cancellation will not delete Your Content immediately.
For a period of 60 days following the effective date of cancellation, you may request an export of Your Content by emailing support@qfield.com.au. We will provide the export in a machine-readable format (such as CSV, JSON, or a downloadable archive of your photos and documents) within a reasonable time of the request. After the 60-day window, Your Content may be deleted in accordance with Section 10.3.
10.1A Account deletion by you
Separately from any subscription cancellation, you may permanently delete your individual user account at any time through the in-app deletion flow described in our Privacy Policy. Deletion takes effect immediately. We do not retain a grace period during which deletion can be reversed.
If you are the only administrator of a company’s account on QField, you must promote another administrator before you can delete your account. This is to prevent the company from losing access to records it is required to maintain.
When your individual account is deleted:
- Your personal information is removed in accordance with Section 7 of the Privacy Policy.
- Records you contributed to a company’s projects remain associated with that company in anonymised form, as required for construction record-keeping obligations.
- The 60-day content export window in Section 10.1 applies to cancellation of a Customer’s subscription, not to deletion of an individual user account. If you need an export before deleting your account, request it from your company’s administrator.
Deletion of your account does not by itself cancel any subscription your company has with us, and does not relieve the Customer of any obligation to pay fees accrued before deletion.
10.2 Termination by us
We may suspend or terminate your access to the Service if:
- You breach these Terms and (where the breach is capable of remedy) do not remedy it within 14 days of being notified
- You fail to pay fees when due
- We are required to do so by law
- Continued provision of the Service to you would expose us to a material legal risk that we cannot reasonably mitigate
Except where doing so is unlawful or impractical (for example, in response to a clear security or legal threat), we will give you reasonable notice before suspending or terminating your access and an opportunity to address the underlying issue.
10.3 Effect of termination
On termination, your right to use the Service ends immediately. We will retain Your Content for a reasonable period to allow export, after which we may delete it. Any rights or obligations that by their nature should survive termination (including indemnities, limitations of liability, and intellectual property provisions) will survive.
11. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that you have under the Competition and Consumer Act 2010 (Cth), including the consumer guarantees under the Australian Consumer Law, where such exclusion, restriction, or modification would be void or unenforceable.
Where the Australian Consumer Law allows us to limit our liability for a failure to comply with a consumer guarantee, we limit our liability to, at our option, supplying the Service again or paying the cost of having the Service supplied again.
12. Warranties and disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available”. We do not warrant that:
- The Service will be uninterrupted, error-free, or completely secure
- Errors in the Service will be corrected within any specific timeframe
- The Service will meet your specific requirements or expectations
QField is a record-keeping and workflow tool. It does not provide engineering advice, building certification, or fire-safety certification. You are responsible for ensuring that the inspections, installations, and records you create using the Service comply with the National Construction Code, relevant Australian Standards, and any other regulatory requirements that apply to your work.
13. Limitation of liability
To the maximum extent permitted by law, and subject to Section 11 (Australian Consumer Law):
- We are not liable for any indirect, incidental, special, consequential, or punitive loss, including loss of profits, revenue, data, goodwill, or business opportunity, even if we have been advised of the possibility of such loss
- Our total aggregate liability to you under or in connection with these Terms in any 12-month period is capped at the fees you have paid us in that 12-month period
14. Indemnity
You agree to indemnify and hold QField harmless from any claim, loss, damage, or expense (including reasonable legal costs) arising out of:
- Your breach of these Terms
- Your use of the Service in violation of any law
- Your Content
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and / or within the Service before the changes take effect. If you continue to use the Service after the changes take effect, you accept the updated Terms.
16. Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia, and the federal laws of Australia that apply in that State. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.
17. General
- Entire agreement. These Terms, together with the Privacy Policy and any plan-specific terms presented at sign-up, are the entire agreement between you and us about the Service.
- Assignment. You may not assign your rights under these Terms without our written consent. We may assign our rights under these Terms to an affiliate or in connection with a business transfer.
- Severability. If any part of these Terms is held to be unenforceable, the rest will continue in effect.
- No waiver. Our failure to enforce a right under these Terms does not waive that right.
- Notices. We may send notices to the email address associated with your account. You can send notices to us at support@qfield.com.au.
